USCIS is one of the most greedy & inefficient organization. People in high offices should complaint about USCIS's Lie which their officials tells the congress all the time for adjudication delays. On one hand they say they are overwhelmed with too many applications, on the other hand they still issue 1 year advance parole, selectively 2 years EAD. They could easily make these documents valid for atleast 2 years, and have just one document for EAD & AP, but since they love to be overwhelmed with applications as they come the checks, they don't mind...

I got an RFE to send copies of my degrees on nov 15th. my attorney sent the copies and my status changed to Response to request for evidence received and processing is resumed. How many days will it take for I-140 approval after the response to RFE to received by USCIS ?
It should be few days not weeks. BTW did your attorney charge money for responding to RFE?

By chance, I was browsing the USCIS homepage when I came across guidelines for the change of address form. It says that not changing your address within 10 days is a criminal misdemeanor. Does anyone know when this law was passed?

Please help me again.
My husband's company lawyer already filed our I-485 but I made a mistake in entering my present company detail. Basically, I'm in H1 also and my transfer is still in process , so the present company detail I entered was for my old company not my new company ( which is still in process but I already got the receipt number). I didnt' know at the time of filing which company to enter that's why. Sorry, for being clueless but I really need your advice. Thank you.

If you didnt initially use your EAD to work, you should be fine because you have a valid H1B! See my other thread on this matter please.

I got married one year ago. My wife was born here and we filed my I-485 and I-130 and I-765 with her.
1- my office in CT state ( hartford)
2- I applied in April 31 2009. My sponsor was from CT and my wife is the petitioner
3- They received my cases and cashed the checks June 10 2009
5- In July 31 I did my biometrics test ( finger print )
6- In Aug 2009 we moved to Michigan and My lawyer is going to transfer the case to MI
8- october 21 they requested some evidence
9- Nov 2009 they requested that the sponsor and the petitioner should have the same address???
10- I changed my sponsor and I have a new one from Michigan.
11- January 9 2010 they accepted that.
12- Feb 3 my Lawyer surprised me and told me that I have an interview in Hartford,CT even tho she changed every thing to MI. She said she has the proof that she changed the address but it didn't update in the system and she blamed the system. she said she is going to reschedule my appointment to MI and she said the are going to send me a new notice in 2 to 3 weeks.
13- Feb 8 2010 they ordered my EAD card.
14- Feb 9 they mailed me a notice that they approved my I-765.
15- My lawyer said they sent my EAD card and the notice to my old address in CT and she said they went back to them and they will re send it to my new address in MI.
16- Feb 22 as of today they updated all my cases but without any new info ( just the dates)
17- I am so confused and I have those questions:
A) Did my case transfer to MI or nothing happen since I moved?
B) how long does it take to get everthing back to the right way?
C) what is going to happen to my EAD card and the NOTICE?
Please help me with this and I will really appreciate it

Is it possible to get F1 status adjusted to H1 without going for a H1 stamping?
Yes. If you have your H1-B approval notice with a start date, say Feb 1, 2008, and I-94 cards with it, then you will automatically be on H1-B from Feb 1, 2008 (assuming that you have valid F-1 status still Jan 31, in this example. OPT is F-1 status).
If your H1-B approval came without I-94 cards, then you need to go out of the country to adjust status.

Does anybody have idea or experience how long it takes for USCIS to make desicion about I-485 expedition (pending for 2.8 years now)?
My hospital sent expedition request to TSC about 3 months ago, there is no replay yet.

We had a 8 hr long meeting with a lobbying firm right on the Capitol hill. The meeting progressed very well. We came out with a wealth of information. This firm seems to have the right contacts and connections. I am creating a pointwise document the people in this firm promised and were confident to achieve. Just to let you know we have Labor Backlog centers and Retrogression on our agenda.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.

What I don't understand is why you are filing another I-140 when you already filed I-485? In any case you can use AC21 only after your 485 has been pending for more than 180 days.
