AFter FP, the LUD is because, during FP, they pull up the records or update the record with your Photo and signatures etc.
Name check is initiated after Notice is generated on ND. So it is seperate from FP.
FP response, not sure what happens when it comes back.

Hello!
My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
If I remember correctly, you are allowed to work for 240 days from the receipt date while your case is pending. If the approval does not come within 240 days, you have to stop working and wait for the approval. You are NOT considered out-of-status as long as your petition was filed before the current H1 expired.

i applied to another university and got my sevis transferred to do my MBA there.
i have done 11 months 20 days of full time CPT at the previous university(where i did my MS).
am i eligible for another full time CPT at my new university where i have started my MBA (from jan 21st 2008)?
the international students service at my previous university is saying "i am eligible for 12months of full time CPT for every educational level, and i cannot get another 12 months if i do MBA because it is a masters degree too".
please suggest.

yes, they're right. CPT is 12 months max full time and it is 12 months for every educational level.

The first picture isn't as good as the others, because it's too dark in the face. You need to wait for the light to hit their face some, and then snap. Harder to do, than to recommend, really.

Hello friends,
I filed for I-485 in mid-June 2007 but never received the receipt notice
(due to the issue described in this thread: http://immigrationvoice.org/forum/showthread.php?t=11788&highlight=undeliverable).
After months of calling USCIS (probably called at least 10-15 times over past 6 months) and having the lawyer send a written letter, I still did not receive the receipt notice as the customer service reps kept telling me that USCIS doesn't send a duplicate receipt notice.
When I saw that one of my friends who had the same issue received a "Replacement Receipt Notice" after calling them numerous times, I decided to call them again. I was able to convince one of the reps to put in a service request requesting "resend whatever was returned to USCIS as undeliverable".
I finally received a letter from USCIS that they will resend the receipt notice but it has been a few weeks since then and I still have not received the promised receipt notice.
Now I need to file for EAD ASAP but it requires you to attach the receipt notice (Notice of Action I-797C or I-797??).
(lawyer didn't file for EAD with I-485 as I have H1)
So my question is:
Can I use the Biometric appointment notice (ASC Appointment Notice I-797C) instead of I-485 Receipt Notice I-797 to file EAD form I-765 as a proof that I filed I-485 ?
What are the odds that they will send my EAD application back saying that I need the actual I-485 receipt notice?
What are my options?

Can somebody file 140/485 if labor is approved today July 18th based on the new directive? How about future Labor approvals, say August 5th? Could somebody plz throw some light on this?
If you labor is approved by July 31st, you can file your I-485 by August 17th.
If your labor is approved on Aug 1st or later, you'll not be able to file I-485 at this time. You can, of course, file I-140.

during our meeting with the lobbyists in Washington D.C. one thing stood clear. We have to get our employers in the big picture and we need to meet the lawmakers. For this we are going to start this effort �Meet the lawmakers�. The material and corresponding will eventually come from the Lobbying firm. But in the mean time we need to build the team. The key might be that your current employer should be able to give you some kind of letter that details your job duties, etc.
If this letter can allude to the duties in your original labor that's all your attorney would need to make your case.

If I transfer my H1-B now to another company, then do I automatically get another 3 years or do I have to file an extension after my H1-B has been transferred?

I am currently in the U.S on H1b for the past 4 years. My H1b is for a computer programmer. I work my day job in that capacity. My Labor certification in under process. I have also been auditioning as an actor for Commercials and Industrial Films. It looks like I may be cast in an industrial film. My question is : If I accept the part, will this violate the terms of my H1-b ? Also, if I am approved for an EAD down the road, can I use the EAD to do acting work on the side ? I just called USCIS to check the status of my case and the Immigration Officer said it is in EB-1 category. I know my case is EB-2.
I asked the IO to see if i have send any paperwork to rectify their mistake, but she said USCIS will automatically adjust the category whe it picks up the case for review
I am confused. Please Advice

I would like to take a quick poll to find number of people who have filed their 485 when they were single and got married later.
The idea is to get a rough number or percentage of people stuck in this boat in the IV community. This would help to start a proposal for a small fix (either admin or legislative) to be passed on to be included as an item in IV's agenda. Believe there are many families stuck in the EB2 of retrogressed countries and many more in all of Eb3 categories who can benefit from a such an initiative.
Here are the options in the Poll:
1. Married; I-485 Filed for everyone in the family at the same time.
2. Married; I-485 filed separately for spouse/ dependent at a later date.
3. Married; yet to file I-485 for spouse/ dependent.
4. Single; yet to get married but filed for 485.

Given that all PDs are now current, is it possible to convert my I-485 to the approved EB2 I-140. This will remove the uncertainty around approval of EB1 I-140. Any advice/experience is appreciated.
You can apply of AOS i.e I 485 only for one application . Since you already have applied for AOS on EB1 I highly doubt u can apply for AOS for EB2. Talk to your lawyer and find out
