    02/01/2007 21/30 p.m.: Senate Passed Immigration Reform Bill Today

    The Senate passed today Fair Minimum Wage Act, H.R. 2 today. The House passed this bill, H.R. 2 and the Senate debated the bill for the past several days. In the process, hundreds of amendments had been introduced on the Senate floor. The Senate floor then agreed to a lot of these amendments. One of these amendments which the Senate had agreed to and passed as Division B of the H.R. 2 is the Immigration Reform bill.
    The immigration reform bill was introduced by Senator John Kerry and agreed to by the floor unanimously. The immigration reform bill that the Senate passed today covers a lot of the provisions which were part of the Comprehensive Immigration Reform Act of 2006 which the Senate passed last year and failed in the House.
    We will analyze the bill and report it step by step for the next several days. Please stay tuned to this website....

    My appln with March 2001 cleared BEC in June, so are tons of such applications in my company that cleared BEC with EB2 pD (atleast 600-800 - our company ). Many were stuck from 2001, as my company did not apply for GC bet 2001 Aug - 2004 Oct.

    can you please tell me the source of these stats? Per the DOL stats, from March 2005 to March 2007 only 130K total cases were approved:

    I can't stop thinking of our efforts in DC. As I have already posted, it was a tremendous experience being a part of such campaign. I came upon this thread of adding more members to IV and from what I read, it was successful largely. IV has increased members from 10,000 to over 40,000 since this thread was started.

    I am bringing back this thread again, asking our members to get more involved in their state chapters and to encourage our current membership to be more active in the forums and action items. We, who participated in the DC event, can hold conference calls (if our members are separated widely across the state) or meet in local libraries (if many of our members are in the same city) and talk of our experience in DC and what needs to be done ahead.

    Fellow participants, please do come up with suggestions on how to keep the momentum going.........

    www.immigration-law.com has now retracted his statement this morning. He maybe following our website and giving updates.

    When our members posted this yesterday, some of our members started accusing IV core of not knowing anything and indirectly saying that they are not doing the job right. Now we have seen that IV core team responded to the thread quickly and gave us the correct answer even before anybody else on the internet could give. That itself shows how much these core people are working hard. It is us that are at fault by not helping them.They are doing all this with the support of mere 200 members that have contributed. I think it is our responsibility to contribute even without their asking us. Let core team do their work and we can all support them from outside.

    Great job IV.

    I wouldn't pass such judgements on immigration-law.com. They've acknowledged the mistake. It's not like no one makes any mistakes, it's how they acknowledge and move forward.

    Hello IV:

    Time and again I see most members skeptical on efforts such as those organized by IV. I happened to surf upon the NumbersUSA website and the general outlay of the website clearly establishes their objectives and motto. Although IV is fighting for a niche stage in the legal immigration process, a stage which almost all non-immigrants have to pass through, it is my perspective that this is never clearly communicated. The NumbersUSA website is visually more informative.

    "Why don't you do it for us?" may be one of the questions resulting from this post. I simply don't have the time which is why I am hoping that my recurring contribution of $50/month can be used for such a purpose.

    Also, a blogspot for the CORE team members and their efforts would nicely keep us busy non-immigrant professionals encouraged on daily or weekly efforts by IV. I honestly swing by everyday to see what IV is upto by frantically looking for a relative subject in the posts of the forum. Alas, only to be deceived by requests for contribution which I am humbly not discouraging, but it is heartburning to swing by IV and then look over the House Clerk's website to see what was in session for the day and what we might potentially be upto, leaving the battle plan of IV to my creative and tired mind.

    "Why contribute if you don't have faith in us?" you may ask. Simple! I feel proud to be an immigrant and fighting for our rights. Not a day passes by when my mind plays tricks on me to sell my 62" Plasma TV, my comfy leather sofa, my Playstation 2 and the two part-time business ventures I formed which will potentially employ 20 americans and give business to marketing, promotions and other agencies to help the venture succeed, to return back to India.

    I am still searching for the right answer...

    Hopefully, my small contribution to IV to aid their massive efforts will help me come closer to the truth and ultimately my decision.

    Do please stay united in your efforts, for the day will never end for non-immigrants alike in their endeavour to succeed and live life hoping that every day they can make a difference in people's lives not knowing that there is no difference in their own because they are caught in a web of misinformed albeit ignorant citizens and this mythical Green(C) monster.

    For all those non-believers, kudos to you for you seem to have mastered the fine art of ignorance without guilt and self-deception.

    Wow! it sure varies by a lot..I just spent $190 for the same
    It varies depending on the physician. I paid $475 for everything blood work to test immunizations + TB test + Physical exam. This is for one person.

    Same physician, my friend went with all medical records and she charged only $250 for doing physical and TB test.

    I got the report with in 3 days. Hope this helps. Good luck.

    Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.

    1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
    2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the �Other Worker� Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
    3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.

    Now let�s go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.

    To be honest with all of you, I was really disappointed in the message from AILA. In the rush to �inform,� they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. My responsibility is to guide you through this process and if there is any genuine worry on my part, I will let you know IMMEDIATELY.

    I just got my wife's medical done ...from the same place where I got mine.
    There is not need of the xray. If you have proof of vaccination good else they will take some of your blood and do your immunization test and return the SEALED envelope after 3 days. cost $190

    This is just a misuse of H1. They should bring up a new law stating the H1 will automatically get cancelled if the beneficiary does not get employed in three months. With this, the real demand for H1 could be estimated easily.

    The speed in which h1 FOR MS in USA shows that there is not that much demand to H1s. Only around 7500 was filled. The H1 Cap 65000 was reached for because Indian companies were rushing to make it before H1 cap is reached. One has to analyse how much is going to be used really. They will use need basis and won't cancel if not used. So increasing to 110k will be enough to meet the real demand but then also Cap will be reached in another 2 months because consulting companies process h1 first and find the job for them later. But Real demand can be analysed in other way. Because of Rushing thro H1s lot of companies which are having Real job demand(Companies like Intel Microsoft) could not hire. H1s for US MS degree holders solved the issue Partialy. May be if the increase that quota to 40k then demand will be enough.

    Couple of questions to all gurus:

    Is there any time limit to say birth certificate is recent? I got my birth certificate in Jan'07, trying to see if i need to sumit the affidavits?

    Also do we need to have copies of all I-94 cards since the first time we entered US? Looks like i don't have the I-94 copy which was issued when i entered in 1999 for the first time. In that case what would be the solution?

    I am not an expert, but as far as I understood it's not the question when the birth certificate is issued, it's when your birth is registered. If the registration date in the birth certificate is a recent date then you need to submit the affidavit.

    You need the most recent I-94 card. All the previous cards are not necessary
