Can I file for I-485 while I am waiting for I-140 approval. My PD is current under eb2 and my I-140 was filed on Jan-2007. I am going to upgrade to PP for I-140 but since lots of people will start going to file for PP, it is very much likely that NSC will issue RFE to reduce there workload. So my question is while I wait for I-140 approval, can I file I-485?

For me the agony is endless. My deshi employer did not provide me the EVL in time though I was able to file in JUNE. They gave it to me after JULY 20th when I stopped sending timesheets.
I am personally not a big supporter of elimination of country quota. Don’t get me wrong. I fully share and understand the endless pain is being gone through by EB3 Indians/Chinese community. Increasing # of EB visa will ease some of their pain.
For an example there are 1000 IT processionals from India wants to come to US with H1/L1/B1. There are ample companies (say 50) owned by Indian and those 1000 IT professionals have enough opportunities to come to US.
On the other hand, for an example, from Ukraine, there are 100 IT professionals are trying to migrate to US with H1/L1/B1 but there are few to none companies (say 1 ) owned by Ukrainians and those 100 IT professionals have few to none opportunity to come to US.
My point is, there are more IT Indians in US do not validate removal of country quota.
Others should get a fair chance – NO MONOPOLY is desirable.
Also New Jersey has too may Indians living, may be one day, there can be revolution, and they might ask for a separate country. I am kidding here.

I sympathize though with non-IT retrogressed people, there isn't such a monopoly outside IT, so them getting delayed because of the presense of large number of IT people from their country may not be fair.. Then again what's fair about indian born in india being retrogressed while indian born in kuwait is not.. We all acceped to start applications within certain rules, saying "not fair" and adjusting the rules at others' expense should only apply to future applications.

This is an extremely bad bill.With India dominating not only the H1 visa quota and EB green cards applications but also body shops and �consulting� companies; eliminating the per country quota would massively and unfairly flood America with workers from India

This has become a ranting thread of EB3 folks. One simple question:
How many of you EB3 India folks who are complaining actually went to Washingtno DC last month for IV Advocacy event?
I hear it was not even 250 people. If you take out all EB2 people, so few EB3 people. This means EB3 people do not really want to do anything but after every visa bulletin come to the site and rant.
We in EB2 do not have much to worry. Our dates will move fast. But you EB3 had a chance last month and you blew it by not doing anything. So stop complaining.
What makes you think that there were no EB3s at the advocacy event and many of EB3s who did not attend contributed to the cause monetarily.....which apparently seem to be helping BE2. May be you should cut the crap and thank EB3s instead of bitching about it.

What USCIS did to the other worker category in June was clearly a violation of Federal regulation (8 CFR Section 245.1(g)) - however since the numbers were insignificant, the violation went unnoticed.
It goes without saying that AILA will file a federal law suit seeking immediate interim relief, if the USCIS does this again...
The repercussions of such a law suit will be worse for the USCIS and very good for the filers. If the judge grants interim relief, that will mean USCIS cannot close the doors until the law suit is settled...USCIS is probably already aware of this possible repercussion and will most certainly avoid this lawsuit situation...
There are an estimated 250,000 (primary) filers expected to take advantage of the July visa bulletin...a number that is hard to go unnoticed...

I believe there are always two camps in any group, different view points, ideas and observations.
I firmly believe even if words are harsh from some members they donot mean that bad, or they just simply cant see other's view point.
Over last few year, i have observed something and that bothers me, the point is
"We (Indians) are interesting people, we want to live as an indian in america";
save a lot of money, go home(india) for 15 days ....say bad things about india
and then come here...start saying bad things about america.
Nothing about this behavior is specific to Indians. It is a first generation immigrant behavior. See if you children are going to do it...
I like some points aobut half hearted work from some fellows. I totally agree.
Here is my simply take, if we want to live and compete hapilly, we have to really live in america as an american.
How can an indian who slept all afternoon on weekend, then watched a movie and ate heavy dinnner at night with 5 indian families who all taked about negative things in america; will /can compete with american on monday morning...when this american
got up early on saturday, ran 10 miles ...full of energy....took his/her kids for camping or went on its own, ran /exercised on sunday may be a long trek in woods...he is fresh, ready to work, creative...
I donot think anyone who slept all week/watched movie/talked negative about american society /about america can compete with someone who lived for full weekend.
Really? An active lifestyle, being outdoors, energetic etc. are qualities of an American? A country where 70% of people are supposed to be overweight? Where some say 30% to 40% of schoolchildren are obese? I would agree with your argument for an active lifestyle versus a lazy one. However generalizing to things like getting up early/running/trekking/outdoorsy etc. as typical American traits is pushing it.
If I want to catch up on my sleep on the weekends, why not? I sleep less than 6 hours a day on average during the week. Sleeping less = poor output and also has been linked to poor cardiac health.
These are just small observations.
In short, most of us are still living an indian life in america. This will not take us far,
If we want to be happy we got to live as an american in america.
Money is not everything,a big bankbalance will do no good to anyone at age of 65 when you cant move your leg let apart run or play.
I also believe, we (indians) donot give time to ourselves. Ex. husband, wife, kids all together all the time. No good, give time to yourself, do somtihngs togehter and some things seperately, This will give time to observe life as an individual too.
You dont have to blindly believe that everything that is American is good.
For example, Americans work the longest hours of any developed country. Does this increase your standard of living. They have the fewest holidays/vacation days.
Maybe doing things separately is your "American way" of fun. Doing things with my family is my way. What's wrong with that. At least we dont have a 50% divorce rate and dont kick our kids out of our homes when they turn 18.

Definitely agree with herd mentality and haste, but can't blame them also. What if the dates go back again next month. So its a catch-22.

What i am trying to say here is firstly reaching congressman should not be on the first day itself which some of the folks are doing, atleast wait for a a couple of weeks. and then regarding opening SR i would say atleast wait for around a week or 10 days at the minimum if you are scared of dates moving back. And yes i am not pointing fingers at any individual so don't take it personally "gc_on_demand"

While this is an important issue, it could be largely addressed if backlogs are eliminated, thus speeding up the adjudication time. At this time there is no specific charter to address this issue, however, this is a problem that persists across the spectrum, and not only in employment-based immigration categories.
