I am the Susan from www.expatsvoice.org and just so you know my husband passed away last year
He was the petitioner for my son who was to follow to join. We only heard son had aged out in Oct 2005 and was getting a court case ready in early 2006.
Sadly my husband became unwell in March 06, diagnosed terminal on 4th May and died 13th May 2006
Someone posted, there maybe only a few cases but the cost is huge from an emotional standpoint
If I win my court case this may result in others having benefit who were previously denied lets hope so and stand together on this.
The grief and deprression I have suffered is unbearable due to errors, delays and husbands death
The memo in cspa clearly says that the CSPA should be interpred expansively, to me that means common sense and compassion.
Until we get an amendment to CSPA I feel there will be so many more cases of hardship and termoil to come to notice

I applied for my wife EAD renewal on May 3, 2010 at Dalls Lock Box Office, following is the message i got from USCIS today:
Your USCIS application/petition has been received and routed to the California Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number
WAC12345678901223. With the official Receipt Notice (Form I-797) you may visit USCIS Home Page (http://www.uscis.gov) where you can check the status of your application using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.
I live in NY and I am not sure why they teansfered it to California. My original I-485 receipt is from california, may be thats why, not sure !!!!!!

DOS allocates GC numbers to USCIS adjustment cases only as the point of approval is reached. DOS can set/move/retrogress PD based on info provided by USCIS about number of cases at point of approval.
USCIS is not able to provide a good estimate of this number because
it can not calculate this number based on USCISs workload, and

I opened the SR yesterday. I still have 40 or so days but the Rep said they take atleast 10 days to decide and if you want to open that should be fine.

I talked to SR and he said that unless I have crossed 90 days , he can not open SR for 765 application. How did you convince him to open the SR for you ?

My friend was in same situation couple of yrs ago and doctor advised not to take immunization as this will affect the pregnancy (baby). so the INS doctor mentioned this in medical form and she did the immunization after delivering baby (almost 2 yrs after filing I-485). so this is not a issue, before your I-485 approval USCIS they will send the query to put vaccination and at that time you can show that you did by showing proof of vaccination.

If we don't contribute at this time, IV may have great difficulty in operating and may even be closed one day. At that time, no one organization would stand up to speak for us!
I have a PD of August 2005. Luckily, I have filed my 140/485 in Sept. 2005. I do believe that, in this forum, I am among the luckiest ones who have more freedom to change jobs and travel outside US. If you are in a situation worse than mine, for example, if you have not get your LC/PERM approved or if you have not file your 485 because of retrogression, don't you think you should be more motivated than me to contribute?
I would change my contribution to $50 monthly if we have 1000+ members to sign up for the monthly contribution. Meanwhile, I would cancel my contribution if this goal cannot be achieved by all our 8400 members within the next two months. I cannot see any point if most people who suffer from the possibility of waiting for years would not contribute while I, who might be one of the least painful ones, contribute.

As per the July 2010 Visa Bulletin, EB3 India should move to February 2002 by end of FY which doesn't really match with most of the calculations given here for EB3(I). So, do you own calculations. Porting to EB2 is an option, but can be challenging given the current labor conditions. In your situation, calculate the time it can take for each stage in case of a fresh application, and decide.

I is only based on a law. In the past CIS used the law to implement one set of policy (horizontal spill over). Since the middle of 2008 CIS is using the same exact set of laws to implement a different set of policy (vertical spill over).
Allocation of immigrant visas is not a policy matter. It is based on law. Any change should come thro law change. Congress (&president) has to amend the law (INA) how to modify the allocation. It is not a simple matter. Both DOS and USCIS knows it unfair to keep EB3-IN in 2001; but they can't do any thing. Thats whu EB3-IN folks should try hard to make the congress to change the law. Contacting DOS or USCIS not going to help, as they have no authoity in changing the allocation methods (they only execute the methods).

You should have filed in July'07 for your son and he was eligible that time even he might have completed 21 years as your I-140 was pending for enough time.
Now you have to wait for date to become current and calculate:
1) Total processing time period for your I-140
2) Your PD become current
3) Completion of your son's 21 years must not have surpassed the processing time for I-140 before you can file his I-485
You should have filed in July'07 for your son and he was eligible that time even he might have completed 21 years as your I-140 was pending for enough time.
Now you have to wait for date to become current and calculate:

2) Your PD become current
3) Completion of your son's 21 years must not have surpassed the processing time for I-140 before you can file his I-485
