    An NRO Primary Document

    Editor's note: This letter was released this morning by John Fonte of the Hudson Institute.
    Prominent Conservatives and Civic Leaders Urge President Bush and Congress to Back Enforcement First on Immigration

    Leading conservatives and civic leaders have signed an �open letter� on immigration declaring that �border and interior enforcement must be funded, operational, implemented, and proven successful � and only then can we debate the status of current illegal immigrants, or the need for new guest worker programs.�


    The signers include William Bennett, Robert Bork, William F Buckley, Ward Connerly, Newt Gingrich, David Horowitz, David Keene, John Leo, Herbert London, Rich Lowry, Daniel Pipes, Phyllis Schlafly, and Thomas Sowell among others.

    Hudson Senior Fellow John Fonte, who organized the letter, said:


    �We want to commend the members of Congress who have supported enforcement first including 85% of all Congressional Republicans, 36 Democrats in the House and 4 in the Senate.�


    �We particularly want to thank Senator Jeff Sessions (R-AL) and House chairmen Jim Sensenbrenner (R-WI) and Peter King (R-NY) for their leadership role in putting America�s national interests in border and interior enforcement first.�

    As a matter of organizational policy, Hudson Institute does not take stances on pending legislation.

    �First Things First on Immigration: An Open Letter to President Bush, Senate Majority Leader Frist, and Speaker of the House, Hastert�

    Recently, columnist Thomas Sowell wrote: �It will take time to see how various new border control methods work out in practice and there is no reason to rush ahead to deal with people already illegally in this country before the facts are in on how well the borders have been secured.�

    We the undersigned agree with this statement. In 1986, Congress passed �comprehensive� immigration reform that included amnesty for around 3 million illegal immigrants, border enforcement, and interior enforcement (employer sanctions). Amnesty came, but enforcement was never seriously implemented either at the border or in the interior.

    Let us not make this mistake again. We favor what Newt Gingrich has described as �sequencing.� First border and interior enforcement must be funded, operational, implemented, and proven successful � and only then can we debate the status of current illegal immigrants, or the need for new guest worker programs. We are in the middle of a global war on terror. 2006 is not 1986. Today, we need proof that enforcement (both at the border and in the interior) is successful before anything else happens. As Ronald Reagan used to say �trust, but verify.�

    The majority of Republicans in the Senate opposed the recently passed Hagel-Martinez bill. Senator Vitter (R-LA) said that because border enforcement will not be in place, �this [bill] will in fact make the illegal immigration problem much bigger.� The No. 3 Republican in the Senate, Senator Rick Santorum (PA) said, �We need a border-security bill first.� Senator Vitter, Senator Santorum, the majority of Senate Republicans, and the majority of House Republicans are right � we need proven enforcement before we do anything else. Adopting cosmetic legislation to appear to be �doing something� about enforcement, but which actually makes the situation worse, is not statesmanship, it is demagogy.

    We thank the majority of the Senate Republicans (33 in all) and the seven Democrats who supported the Isakson amendment, which insists upon verifiable benchmarks for border security before considering other issues. Moreover, we say �Thank You� to Jim Sensenbrenner, Peter King, and the bi-partisan House majority including 36 Democrats, that passed HR 4437. We may quibble with a clause here and there, but you in the House and the majority of Senate Republicans are right to emphasize that the Congress and the President must deal with enforcement first and other issues later. Stand fast; the American people are overwhelmingly with you.

    Is there any one who has got EAD renewed in the last 2 months ie in Feb, March 2010?
    As some one mentioned the lockbox creating delays , Im frm SFO , CA so according to the new I-765 instructions so I need to mail it to the Phoenix , AZ lockbox, am I correct?


    Has any one been successful in getting an interim EAD ,in the recent past (6 months ) by going to their local USCIS office in case they didnt get their EAD's in time ie before the current EAD expires?

    No impact on BEC approvals on retrogression, BECAUSE THEY NEED TO GET I-140 to be approved, then only their case to be on the line for visa number. Now no premium processing, their I-140 is going to get approved dring May OR June 2008. Till then the guys with I-140 approved and filed in June 2007 get GC. BEC approvals on 2001, 2002, 2003 cases after june 30th (last date for premium) will be on above catagory.

    I agree with you. That's the reason I feel USCIS is just taking time to get their act together and move forward with PD.

    I am very doubtful that DOS would open the gates completely next July (like this year) as they had very bad experience. But EB3 dates may move to early 2005 (March 2005 may be - before PERM was launched) and EB2 close to 2006.

    This is the precise reason I am staying away from IV, people just dont show any civility in the forum discussions and starts name calling or shot down the people who ask questions.

    If IV comes up with just one single GOAL of reducing the curent EB backlog for the restorgressed categories, people even from RoW countries will start participating in IV campaign and support IV's advocacy efforts in terms of their donations and volunteering for IV.

    Reducing the current EB backlog will help everyone.

    I called up the number yesterday and luckily some lady picked up. She was not even willing to answer :((. When I asked about the status, she said it will take 20 days time. I dont know why they have mentioned it in website as 7 business days. I think indian consulate doesnt know the meaning of customer service.     But I am still not clear if I can apply in EB2 (PERM) as the job requirement says

    Minimum of 5 years programming experience

    But is really important to SAY THAT’S MASTERS DEGREE PREFERRED,
    Because I have Masters in computer science but the job requirement does not need it.

    To apply in EB2? Or just BS+5 years of experience is good enough

    Form information posted I deduce that BS= 2years of experience
    I have 5 years of experience so total of 7 years (SVP of 8) as per

    well I would like to add, I do know details of how a Bill gets created, is reviewed, gets to the Floor of the house, Senate and becomes law.
    I do know that once a member of either house presents a Bill, it has to be sponsored, supported by others and go to a sub-committee first. sometimes gets added to other bills.
    lets assume by luck or other means it somehow makes it to the floor.

    I would really want to see which lawmaker would possibly vote against a Bill that aims to reduce wait time for a Green Card from the existing 10-15 years for legal workers to an average 2-3 years.
    That would send a very strong negative message to all legal immigrants, and especially India, China, including hundreds of thousands of university students, engineers, doctors and other professionals. It also sends a message to millions of future students, professionals.

    Don't you think that they risk their reputation by voting against this Bill? Not to mention shaking the foundation of capitalism.
    This vote will stick with them for the rest of their career.

    if they are voting on party lines or other lines, It would give us a good picture and make our job easier in the future.

    Some of them said they would pass on the message (but I noticed they didn't make a note of the bills ..I was wondering if they know these bills on the top of their head). some of them said they have received lot of calls from IV.

    The person I spoke with(David) when I asked for Ruben Hinojosa said that Ruben Hinojosa is pro-immigration . He said he(David) spoke with the Congressman about these issues and said Rep. is aware of skilled immigration problems.He said that though ZOe Lofgren sub committe is sponsoring the bills Ruben is working with his colleagues in favour of the bills.
    Said Democrtas are trying to get a Democrat into '' (I don't remember where now, may be White House) so a broader immigration law can be passed.
    He said after August recess some of the immigration bills would be passed.

    I just returned from an INFOPASS appointment for checking up on my case status.

    Their systems were down! They could not access any records, and the IO kept saying that it's down and you should get a decision in a few months.

    I was adamant, and asked her if it's possible to reach someone else at NSC - she called asked about my status - she kept saying, "good, good", and then she turns around and says that my case is approved :D:D:D, and that if I don't get my card in the next 30 days, (the usual stuff!). She then made a remark to the person from NSC that these guys know more about their cases than we do - as we go to the IO with all sorts of information about the VB.

    I made sure that they verified my current address, as I had bought a house and moved about a year back, but wanted to make sure that the address was updated after filing the AR-11 back then.

    So, the important lesson learnt was that cases are being approved, but the online systems are not being updated.

    Just hold on... It's on it's way. Will provide an update once I get the cards.

    Great Idea. Since this is Saralayar brain child, let us all nominate him/her to lead this venture , while us IV followers pursue more servile task's like trying to recapture visa numbers, get multi year EAD's and basically save our B*^$'s.
    If this venture is a success Saralayar will be a citizen in a year (along with a few side kicks that are backing this new citizenship concept) or so and then he/she can push congress to pass the other minor legislation that will bail the rest of us out.

    Waiting is all we have been doing for so many years. I have been living separately from my wife for last 3 years. When I reached out to Pappu on IV, he refused to do anything for me. I am ready to come forward and talk to media but nobody is here to listen.

    I am seriously considering some media awakening event these days, it might be suicide or whatever it takes but this DOS stupidity has to stop. Its affecting so many people's life. I agree GC is not a right that we can demand from US government but they can't treat us like this after investing so many productive years for this Economy.

    I am also thinking of organizing an event around where I live which would me media spotlight. Legal immigrants like us esepcially EB folks need to be in news by doing something special(organizing a food drive for homeless, offering thrash cleaning in some place around .. etc,summary is volunteer in groups)
    BTW no one thinks we are investing time here. We are paid for what we do, the matter ends there.
