Dhundhun,
What is your PD? There is a portion of the memorandum that needs your child's age at the later of the date when PD is current or when petition is approved if PD is current by petition approval date.
I think you should submit an I-485 for your child as soon as possible or if the child is not in the US then file a I-824 immediately. This will serve as proof that your child "sought LPR status" within one year of your PD becoming current. Even if the 485 or 824 is rejected, you have established the fact that your child "sought LPR status" and leave room for administrative appeal in future.
This is just my 2 cents and I am not a lawyer. However, whichever way you interprete the new memorandum your child's CSPA age is under 21.

Alright buddy, The only loan I've is few hundred dollars on my credit card which I pay every month though! Car is paid and no home! Sorry, no money from me to you! You have to find another person! I can buy you a cup of coffee though so that you can relax a bit!
Dude, now again you are taking it personal.:) Just because I replied to your post, you think everything was directed at you. Do you seriously think I have anything against you? That other guy masternyc is mentally retarded, not you.
But I do respect if any non GC holder go and buy a home.
I agree with your point about defaulters. But take your argument elsewhere.
In California, a musician who claimed 100K income/year was asked to stand in front of his home with his musical instrument and photographed. That photograph went into Washington Mutual's file as income proof.
I have heard this argument zillion times. So you are saying the musician should be bailed out, right? Dude, such musicians need to do 10 years of time! Instead, they are just declaring bankruptcy and walking away with a spoiled credit. And you seriously think they won't get loans in future? Sure they will. Loan interest is basically what a consumer bank profits on.
If you think, the housing crisis is because of defaulters, you are partially wrong! Prices went very high and people couldnt buy and that is the reason home prices went down. Since it went down, loans backed up by those very assets lost value. And people defaulted because what they owe was higher than the value of home!
You are really delusional if you think non GC home-owners are to be blamed for this mess!
No, you are partially wrong! Prices didn't come down because people couldn't buy. They crashed because of the huge number of foreclosures. Otherwise, you would have seen them stagnated for a while and then starting climbing down.
Did I ever say non-GC home owners are responsible for this mess? Now, you are drawing your own conclusions and attributing something to me which I never said :D.
All I am saying is folks who are forced to return to their home country should clear off their dues. That's all. Nothing more, nothing less. I have seen a friend who wanted to run away leaving his car behind in the mall in 2001. I advised him against it despite he saying I'm not coming back, not coming back. Finally he did the right thing, returned with $0.0 and he did come back in a year. People always come back, especially when they are forced to return against their wishes. Not clearing off your dues is absolutely criminal. And there is huge, huge difference between $20k car and $700-800k house in SF Bay area.
Finally, I think you are also partially right - even today the banks don't have proper checks for mortgages. The rate is down upto to 4.5% and there is not much change in the policy. All that 20% down thing will never happen in anytime in near future! There are just no takers!!
You really need a good tax refund from the government! File your taxes soon!
Another assumption. I always underpay my taxes and give thousands and thousands back to the govt at the year end. California tax board is bankrupt and most likely going to issue promissary notes, if you haven't heard. I don't trust this bankrupt governments.

I am an American, born and raised in the US and I wholly support Team IV. This initiative not only supports IV, but also helps prevent childhood obesity in the US which are two very important issues that we currently face. Being an avid runner, I am always looking for worthy causes to support via running and I am excited to be a part of this Team.

You can request them for a separate fastrack queue for legal high skilled, currently employed, workers who can buy a house with a substantial down payment. This has been making rounds in various news papers except for IV. In this economic climate, it's worthwhile atleast to make a such a proposal.

Due to the delays in obtaining EAD from Nebraska Service Center; I am planning to do the following things-
1. On the 78th. day (since currently NSC is taking 11 weeks= 77 days, to process EAD cards) call USCIS customer support 1-800 number and tell them that my case is outside the processing timeframe.
However, if I do this, my case gets locked up. That is any call the customer service representative takes and opens a service request; another service request cannot be opened earlier than 30 days.
2. Even still if my application is not approved, then I plan to walk into the USCIS office on the 91st day and request an interim card.
My question is since, I opened a Service Request on the 78th. day, can the local office representative open another service request to request an interim card on the 91st. day, since 30 days did not pass from opening my service request.
Gurus, please comment.
E-Filed on 04/15 . Wifes EAD Card received on 06/01. Mine still says initial review so Initiated a service request but looks like it would not have much impact as case is still under normal processing times.
Getting concerned now since my current EAD expires on 90th day.

this is not just a question of depriving those who did not come.
let's please recognise that many people did have genuine compulsions as well.
the more important issue at hand is that sensitive information should not be released on an open forum. state chapters are free to organize live meetings and brief their members on lawmaker meeting experiences. those who attend chapter sessions are welcome to participate and learn- and join in for future meetings which should continue at the district/state level.

nice posters (soft copy only...authorized by IV....we can print in our local areas) to be placed in Grocery shops (mainly Indian stores mostly they accept) to attract new and inactive members to participate/contribute to this event. I am ready to place it in my area (4 stores I can reach).
Also how about pamphlets (again soft copy..authorized by IV...we can print it in our local) placed in stores for people to pick and read it (some may act on it). May be 1 in 100 will join which is reasonable (not a great) reach.
This is a good idea.
Could you find people willing to help create posters on a new thread. IV can help form a group that would take care of all creating posters, fliers, banner ads etc for this event.

Here is what the attorney firm (one of the top ones in the nation) used by my company sent. They are trying to file all applications by July 1st week.
The fact that they are not dismissing this as a rumour means that they accept there is a "chance" however small that may be that the USCIS can stop accepting applications and they can do nothing about it at that point.
Yes in a way they are cushioning themselves, by sending out these client alerts, so that they are not held at fault if this may happen. But if there was absolutely no chance for this to happen they would certainly have dismissed it outright as a rumour.
---------------------------------
July Adjustment of Status Filings May Be At Risk
Recent rumors have called into question the accuracy of the Department of State's July 2007 Visa Bulletin, which announced that all employment-based categories, with the exception of the "Other Workers" category, will be "current" (i.e. immigrant visa numbers will be available) as of July 1, 2007. These rumors have suggested that United States Citizenship and Immigration Services (USCIS) may potentially, notwithstanding the July Visa Bulletin, not accept adjustment of status filings for all, or a part, of July.
Fueling concern over this possibility is the fact that, during June, USCIS took the unprecedented step of refusing to accept adjustment applications in the third preference "Other Workers" category filed after June 6, even though the bulletin showed numbers available throughout the month. USCIS took this step evidently after receiving notice from the State Department, outside the visa bulletin process, that the available numbers had been exhausted. There are strong legal reasons supporting the argument that this action by USCIS was improper. Nevertheless, the fear is that USCIS will take a similar step with respect to all or some employment-based adjustment of status filings made during July.
The widespread belief among immigration experts is that, even if USCIS accepts all employment-based adjustment of status cases sent for filing in July, there will quickly be another rapid retrogression of immigrant visa availability. This would result in potentially many thousands of newly-filed adjustment cases remaining at USCIS for quite some time while applicants wait for the immigrant visa numbers to again become current.
Obviously, a decision by USCIS not to accept adjustment of status applications for some or all employment-based categories during all or part of July would be a devastating development for companies and foreign national employees who have relied on the July Visa Bulletin and are preparing to file adjustments. Many organizations, including ***** and the Global Personnel Alliance, are working to determine the true position of USCIS and the Department of State on this issue and to advocate for USCIS to accept all adjustments filed during the entire month of July in accordance with the July Visa Bulletin. We will send an update when definitive information is available.

Honorable Lofgren had brought about very valid points and it seems too good to be true. (pessimism)
But if this is true We are all in, in next few days. (optimism).
The Twist is if this is true chances are H. Lofgren will cut a deal, remember there are heavyweights on the other side too. Its too embarrasing for all of them. ( realism)
I wish my optimism comes true though, that way I can tell my children when they grow up as to who made the difference and stood up for RIGHT CAUSE and questioned WRONG DOING without fear and that would be Hon. Lofgren.

Looks like now I have to go to their homes again and get them to sign up for Monthly contribution. People just dont get it.

When Jun-July 2004 PD will be current? Any guess?
No one knows dick about PD movement. EB3 filers think that somehow EB2 PD gets stuck or even retrogress and EB3 PDs race forward to 2003/2004, through some delusional logic. Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.
My two cents...
