The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)

I think IV should work on filing a CLASS ACTION LAWSUIT for several reasons. Are we going to be coward legals waiting, for lazy folks at USCIS to undo the wrong they've done for so many years.
1. Blatant errors in the processing which has, destroyed , causing huge stress, trauma and what not to ppl waiting in limbo.
2. Inability to provide any insight on the basic timeline for any application. Look at the EB backlogs, they change there bulletin as if its a stock market, it can go forward or backward depending on the mood of the ppl working on any day.
3. Immigration is a burden on the legal immigrants, we pay for those ppl jobs. How can they offer such a sub-standard service, considering the hefty fees they charge from us.
4. The US constitution says " We the people", does not say "Legal Aliens" don't have any say or can't ask for justice.
5. We are legals, did not cross any border like those illegals, which this administration is so concerned about. We pay for services, not screw ups!
6. Lost EB visas for USCIS / DOS mis-handling.
7. Even if we loose the lawsuit, still we made our point. USCIS sucks! period
Ok now, i'm ready for all the red dots, who think that keeping quite will some how magically solve these problems. They need to be held accountable for what they've done.

Order of processing has nothing to do with PD being current. Now this is not an opinion it is a crystal clear CIS pronounced fact. (http://www.murthy.com/news/n_nsccpr.html)
Pre-adjudication where work continues irrespective of visa # availability (where everything else is done except visa # allocation) happens as per the RD of the I-485.
Now even if gc101's I-485 get's pre-adjudicated sometime next year w/o PD being current his I-485 is not "approved" unless visa # is allocated. Now suppose his PD becomes current after his app. is pre-adj., he has very little time to add the spouse name as there is chance like in June that they may quickly assign the visa # and "approve" the file in days.
So gc101 would be safe if his PD becomes current before his file is pre-adj or get's stuck (!) in something like FBI namecheck after pre-adj. which might allow him time to add his wife's name.
My company lawyer addressed this part. The way it works is that they will work on your file only when your PD is current. So even if you apply now, they most likely wont work on it after July as your PD wont be current. Then when next time (say in Jan 2008) when your PD becomes current, they will pick up all the files for that month and start working on it. It might be that they will work on your file on Jan1st or Jan 31st. You can send your wife AOS the moment your PD becomes current. So you want to make sure that it reaches there before they approve your AOS. In case you are extremely unlucky, then they would start working on your file on 1st day of the month and finish it before end of that day, making it impossible for your wife's application to go through. Thats rare though. So if you can make sure that her app reaches on 1st day of the month in which PD is current, then they should most likely add her to your AOS and work on those together and make your life go forward....its a chance which you will be taking...But again life is a chance

I am no expert here but know that most of my friends did not have priority date current but were getting EAD/AP all the time. So once filed and accepted (receipt#) I am sure you would get an EAD/AP (the first one would come quickly 2-3 months) then extentions of EAD/AP might have a different outcome.

I-94 form does not have any such thing.. But DS-156 and 157 might have.. so if the guy goes and does not apply for a visa he shud be fine i think...

In its Response to the Ombudsman’s 2006 Annual Report recommendation (AR 2006 – 01), USCIS agreed in principle to provide a breakdown of all incomplete cases by the number of months pending and application type, and stated (at p. 7):
Given the constraints of existing legacy case management systems, USCIS would today need to perform a cumbersome, labor intensive, recurring manual audit of all pending files in order to compile the suggested data. Such audits would be cost prohibitive. (page 13)
USCIS has opted not to use its limited financial resources to extract data from current systems and prefers to spend it on prospective systems that are years in the planning. For example, USCIS has not made corrections to the CLAIMS 3 system to capture data on applicants’ priority date information, country of nationality, and the preference category under which the application is filed that USCIS must review before the application is accepted for green card processing. (page 13)
Failing to correct the system annually results in hundreds, if not thousands, of wasted hours by all levels of USCIS leadership in trying to account for an often asked question by Congress, the Ombudsman, stakeholders, and others: “Exactly how many employment-based green card applications does the agency have pending?” USCIS still cannot answer that question today with certainty. (page 13)
Others expressed skepticism about the Department of Homeland Security's ability to enforce the measures, pointing out that the department cannot even come up with the number of high-skilled visa-holders in the country. I visited the PA DMV yesterday to renew my driving licence based on my pending I-485. With all the valid documents like EAD, I-485, SSN card, I-94 etc. They refused to renew it saying that they have a new pilot program implemented called SAVE and need to get clearence from that, it will take upto 30 days. Anybody else gone throgh this proces?? Day by day more hurdles to pass...what a life, why dont they keep their systems uptodate or provide some temp permit as long as their check is pending. I am frustated with all this GC process, name check, DL SAVE system check etc..Why dont they implement just one check and give approval to everything.. atleast make it less time consuming.

No questions asked, no documentation asked. Just sent out the fee in the mail and received the renewed linense in 2 weeks.
I'm from Michigan.

Please stop dreaming. if you want to influence, go meet them! that remain's iv's official word on the matter too...see the meet the lawmaker campaign. and if you already have...you have my respect, you are too good in that case to waste your time complaining about this stuff.

IT and BPO outsourcing is also leading to Americanization of Indian youth and Indian youth are spending their high salaries on American products. In no time you will see American fast food chains, groceries, and many American MNCs cashing on a Americanized Indian crowd and neutralize ( and will eventually exceed the investments they make).
This is the beginning of Americanization. Most of you will not understand what I say because you are here in US for a long time and being first generation immigrants (on a limbo) keep up with your tradition. Americanization is like a slow bleed. IT and BPO is investment. Returns will come in form of MNCs and businesses and finally benefit American economy.
Just go back to India and look into the ITand BPO companies and lifestyles of people there. it will be 5 times higher than what we follow here as the Americanization is already induced.
Bottomline, do not underestimate America. They know what they do.

I will be facing the same prob if i dont get my extension in-time. At least EADwill work,meanwhileI am filing for my H1B extension ,but dont want to spend another 1000$ just to expedite the process for DL...

1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed
2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Which company should I say I am working for present or the future ? Also If I do take a leave of absence should I send in AC 21 paperwork or no?
PLEASE HELP I am very confused--- I strongly feel that the leave of absence might be an insurance policy but I don't know how to approach it !!
There is no such thing as "invoking" AC21. Its a law. Most important thing is, your I-140 must have been approved and I-485 is pending for more then 180 days....you are Free to sail in the same or similar field.

Technically it should be your original receipt date , thats means your wife 140 should be processed now but guess what that happens only if TSC finds your wifes file , not sure where the tranfer cases are stored , If they use computer they will definetly find the case but looks like they find the cases by boxes ... I m in the same boat and waiting for 140 approval after transfer to TSC , hope they find our box one day
