Please help.
I am in the process of filing PERM. Ads have been placed etc and all the
formalities completed. Now, we are at a stage where the forms have to be prepared, signed and submitted. However, i am very unhappy with my attorney. He is unethical and i am afraid he will screw me up. So here are the questions
1) At this stage ( not yet filed PERM) but on the verge of filing, is it possible to change attorney or is the job order etc specific to the Attorney.
2) In form ETA -9089, in the Alien Work Experince section, it says to give the name of the aliens supervisor and the employers phone number.
MY attorney says this is not required. Any thought on this. Did your forms mention this ?
3) I am afraid my Attorney will deliberately mess up the form. What should I watch out for in the form before signing on it ?
4) IS there any redressal system at all in this country for Attorney Malpractice ? Anyone taken this route before ?
Guys, please help me as I have to take a qucik decision.

This is the longest time. All other forms of recruitment needs to wait only 30 days and you can file PERM on the 31st day. There is no mention of working days or weekends, it is 30 continuous days. As you know in addition to this job bank order, and two Sunday newspaper ads, there has to be three other forms of recruitment before you can file PERM. If your employer and lawyer are really proactive it will only take 60 days to file PERM from start to finish. You also have to get a prevailing wage determination and post it at your job site for 10 days not including holidays and weekends. Hope this helps. Be what you are, Don't change yourself just to fit in crowd
I read a lot in this for people criticizing"Indians" who live in rented appt and not buying house Or living froogly and all....Everyone is coming different background family history. Every one has full right to live the way they want. We should not be judging based on how they live there life, unless it interfere with your life.
If we (I Or Anyone) decides to live the Americans live like doing camping and stuff over the weekend that is totaly individual preference. We shall never say that families (Indian) who don't like or don't prefer to do out door activity and stuff there kids will have nothing to talk about at school. Eventhough I personally like camping but I don't like camping because just to copy with american.
So Let's please not judge anyone, everyone makes the choice based on whatever they think is best for them. As long as there are not doing that by hurting someone, it's fine.
I wish everyone be happy ( Homeowners OR Non HomeOwners). Live the life at fullest. Living the life to fullest does not mean just spending money. You can be happy by spending time with family, Parents and friends.

You should have filed in July'07 for your son and he was eligible that time even he might have completed 21 years as your I-140 was pending for enough time.
Now you have to wait for date to become current and calculate:
1) Total processing time period for your I-140
2) Your PD become current
3) Completion of your son's 21 years must not have surpassed the processing time for I-140 before you can file his I-485

Lets not get stuck in debating and talking all the new news about legislation being introduced, Skil/CIR. The most important thing is to create awareness about problems we are facing (EB immigrants).
Time again we have seen that because of low awareness amongst all the peoples-reps (congressmen, senators, all others) our provisions have been dropped at the last minute.
The need of the hour is to keep working together as a unified team, we all do a good job as a team. We have seen that during the lame duck and also before in May, 2006.
IV core as a team exactly knows what is best for all of us. We have to trust them and help them do their thing, meanwhile we can all concentrate on
1)raising awareness, writing op/eds. writing to editors
2) Inviting other people who are stuck like us (to be IV members). Strength is in the numbers.
3) Creating a huge fund to help lobby/or other such activity that we need it for.
Some new members might doubt the intentions and the commitment of the core team. Also it is very easy to be skeptical of people asking for funds. When I was new to the IV team, I had the intitial skepticism about people on the forum asking for funds and contributing. It took me a good 2 weeks of being a guest on the site to register and then another 10-12 days to give my first contribution. So from that standpoint, I know that new people on the forum are going to take some time to trust IV and have faith in the core leadership. All we can do is to get new members (So many thousands stuck in retrogression). New members inturn will become active in a short time, Bigger and stronger IV with a 10,000+ membership will ensure being noticed and also will have the required funds to make it happen this year.

Thanks for your confidence in me, but it is all relative, I think I am a slow, average runner, slower than most of my running friends.
When I started running 10 years ago, my goal on the indoor track was to go around the track 2 times without having to stop and walk. Those 2 rounds made up a small distance of less than a quarter of a mile! So you see, small goals can one day lead you to a 26.2 mile goal as well :)

^^^ Very well said...Right on target. Also I would add to 'learn the ropes' we (as in volunteers) can take up the I485 initiative and work towards its success. That will certainly give us valuable exposure to build long term relationships with lawmakers.

You MUST be physically present in US when you apply 485, otherwise CP is the other option.

Can you all please post what your lawyer's take is on this matter. My lawyer also said that there is no need to worry and saying that she went on vacation till next Wednesday.
I just can't get enought of these lawyers, and government agencies. Who says India is any worse? Have you heard of anything like that in India?

One more idea
For Those who had spent more than five years in the US paying Federal Taxes, are highly skilled (MS) in STEM fields and has been delayed due to name check or Backlog etc. 5 (or 3 yrs) period should be counted from the date of receipt of I-485. (They definately need to get GC before they can apply for citizenship, counting this period)

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

The number of cases approved during 2002-2005 was at least 2-3 times what was being approved now(when recapture was in force)... improving efficiency will not give us any more visas... if there are 100k waiting for a GC they will still keep waiting no matter how efficient USCIS is. The fact of the matter is that they can only approve 3k per category per country. recaptured visas are free of country and category caps. It will not cause divisions or issues and will help unite everyone behind one cause. Other short term issues dont help(multiyear EADs or APs and such)...they just prolong the pain and drain money every year. The queue can only be reduced, by time or attrition or more output... we can all agree which is better.
Firstly the fact that there are hundreds of thousands of un-used visa's is a clear indicator of poor USCIS efficiency. Even if the recapture visa effort bears fruit and people will get interim benefit it will do nothing to improve the efficiency of processing cases at USCIS which I think is the root cause of this problem. Yes there is also a supply and demand situation but unless USCIS improves the delays and backlogs may not stand a chance.
