Green Card Visa Numbers Situation
� The GC process involves Labor Certification (2-3 months) + I-140 (0-12 Months) + Wait for priority dates to become current (several years) + security checks (1 month to 2 years) + I-485 processing once priority dates become current (18 months to 3 years).
� Yearly green cards quota for employment based applicants is 140,000. This includes visas for spouses and children. So on an average; it is given to ~ 60,000 families.
� Country visas limit is 7%, with almost equal distribution for EB-1, EB-2 and EB-3 plus any unused visas from other countries. Generally speaking, for countries like India, approximately 7000 visas (~3000 families) were being issued every year in each of these categories.
� It is estimated that approximately 500K+ (yes 500K) I-485 applications under skilled worker category were filed between July 2nd and August 17th 2007. Most of these applications were from people of India and China.

Why don't we mail copies of our degree certificates, diplomas and other credentials? They will know who is more educated..Lou Dobbs or us !!!

Is there any way EB2 can be filed. What should I tell my compary lawyer? I told him my friends in other companies are able to file EB2. they are also software developers. He says "The other companies should not be able to file EB2 for software engineers but I can't say what another company's hiring history would allow and what they are willing to risk in filing a case which surpasses the minimum requirements allowed by DOL."
How do I convince him. Is there any documentation or link which I can show him which states that software developers can file EB2?

My job was advertized as Bachelor plus four years experience even though HR agreed it required 5 years experience. God save us from fat a** corporate lawyers.

I have seen it happening a lot of times. You would not believe, I have seen management floating dummy projects, just to burn left over money so that they can claim the same amount next year. If they do not burn the cash, it would be hard for management to secure the same amount of budget very next year. You know, Sanju is so true! I have even seen management "encouraging" consultants to do over time. That way, consulting companies get more cash and hiring managers get paid "vacation(s)" somewhere near South Africa or Peru or Rio! Sanju - Well said, felt like something that I have seen at my client's location.

So here come the thing. Thats why i asked in my original post is IV just for people who have applied for Green card ? I wanted to know if they could address these issues as well . Regarding inability to work and self esteem , just stay in home for few days and then feel how much you loose. Man , its 21st century and ability to work is basic right.

If tomorrow there is a bill to stop all H1B from coming to USA or to make life difficult for H1B, do you really think we will keep quiet just because we have filed our greencards?
Do you know IV worked hard for decoupling of H4 time from H1 in 2006 and we thought nothing may happen and started to focus on next action item. Then few months later it was changed. That was the first small step.
I would appreciate if you ask your spouse if she/he can volunteer time for IV. You both can get more involved. Send us an email if you are interested. We are always interested in people who can volunteer more time than us (We do full time jobs too. A couple of us also are enrolled in a part time degree program). We are willing to have such an H4 be a leader in IV.
IV is a platform that will allow you voice your plight. But you will need to come forward and be willing to actively work on it with others. If the strategy is right, you are committed and have right intentions there is no reason why IV will not help.

Think of it this way. Conservative estimations say that in the recent application rush, USCIS received 300K applications.
That is 2 year's worth of applications alone, not including those already at USCIS.
If you compound that with the asinine 7% country limit, and assume that there are MUCH more than 7% of that 300K from Indian nationality - I'd say you are looking at much longer than a 3 year wait on average. I'd guestimate 7 years.
The only way this will change is to support the DC rally. We are getting major traction and positive news on this and it's potential affects. Please do everything you can to come.
There are people offering to pay 100% of airfare, there are free buses being set up. There are very few valid reasons not to come!
Be part of history!

BTW you don't need rbi clearance.
You can send an overseas wire from india through your bank a/c where the cost would be minimal( only exchange rate diff and cost of wire($25-50).
Your parents can safely gift you $100,000 a year. Your bank only would need a letter from them saying its a gift.
I have tried this to repatriate my assets and it works all the time.
No need to open nre or nro a/c or anything.
ps. don;t entertain any solicitation on this site for reverse hawala or anyhthing as you don;t know who will cheat you!

You are not reading it correctly. Lawsuit is not limited to July 2nd filers. That is the reason why attorney's are encouraging to file even now.
On your backfire note, you gotta read Pappu and logiclife postings about some people being happy about the July bulletin fiasco. Read it over the weekend. Those are great postings.

Yes, facing the same issue. I mailed my application on Jan 12th, got the receipt on Jan 28th.
Hoping the information would get updated today. If not, we would have to wait till 15th. I tried calling the 1800 number, the support person had no idea on the updates since this case is with the National Records Centre.

Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.
Our angst, our insecurity:
Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.
Early effort wins:
The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.
How you can help:
You and help in two different ways:
Join the advocacy effort in DC on June 7th and 8th. What will students get out of it? Their Green cards are not stuck? Are you offering them H1B visa that they desperately want? They do not care about Green cards. They only care for scholarship, a job after graduation and H1B sponsorship from the employer. You are offering nothing from this list.

If we cannot help ourselves and stand up for ourselves, nobody else would.
I am trying to take at least a day off from work. I would lose money from my wages if I take day off but I am ready to lose money for the sake of doing something good for myself and family. Others who are sitting on their armchairs should also consider coming to DC if they want their greencards.

However, students who have just started off with their studies here and have 2-3 years before graduation can definitely gain a lot if the CIR is passed. Also, a lot of these student organizations have the contact details of their past members, members who are now working mostly in the US and these organizations can contact those members requesting them to join in this advocacy.

I have noticed that most "overzealous" CBP officials are found in smaller airports. Large airports like JFK, DC, Miami, SFO etc have efficient and effective CBP officials - they are really busy doing their jobs and don't have time to overdo their job.

often times i have noticed that the blissfully ignorant GC applicants come better off than rest of us- who act like chicken with the head cut off after every bad news!!! may be they dont worry too much and look at it from a whole another perspective...who knows...i wish i could be one of those, but i am too far in the game...damage is already done...:D
